1. Who we are

This website is operated by Scalworks Scaffolding Ltd (“Scalworks”, “we”, “us”), a Kenyan company that supplies, hires, erects, dismantles and inspects temporary access systems. We are based in Nairobi, Kenya.

2. Scope

This policy covers personal data collected through this website (including the contact form), email, telephone and WhatsApp in connection with enquiries about hire, sales, erection, inspection and related site work. It does not replace a written hire, sale or erection contract. Separate terms may apply once we accept a job.

We process personal data in line with the Kenya Data Protection Act, 2019, and any regulations issued under it.

3. What we collect

Information you send us

If you use the quotation form, email or WhatsApp, we may receive:

• Name and company name
• Phone number and email address
• Site location
• The type of work you need and your message (height, load, programme, drawings or photos you attach)

The website contact form prepares an email to Scalworks@gmail.com in your own mail application. We receive that data only if you click send. We do not store the form on this website’s server.

Technical data

Like most websites, our host and WordPress may record the IP address, browser type, pages visited, date and time, and a small number of cookies needed to run the site. We do not use this page to describe a separate advertising profile.

4. Why we use it

We use the data you give us to:

• Answer quotation requests and discuss hire, sales or site work
• Arrange delivery, collection, erection, inspection or after-sales contact
• Keep records of jobs, invoices and safety-related correspondence where the law or the contract requires it
• Operate and secure this website

The legal bases we rely on are: taking steps at your request before a contract; performing a contract; our legitimate interests in running a scaffolding business; and compliance with Kenyan law (including tax and health-and-safety records) where that applies.

5. Who else may see it

We do not sell your contact details. We may share what is necessary with:

• Email, hosting and WordPress providers that keep this site online
• WhatsApp / Meta, if you choose to message us on WhatsApp
• Google, if you load the map on the Contact Us page (Google Maps) or if your browser requests Google Fonts used on these pages
• Transport, fabrication or other subcontractors engaged on your job, where they need site and contact details to perform the work
• Professional advisers, insurers, banks, or public authorities where Kenyan law requires it

Those third parties have their own privacy terms when you use their products (for example WhatsApp or Google Maps).

6. Cookies and the map

The site may set essential cookies so pages load and the WordPress session works. The Contact Us page embeds a Google Map of Nairobi. Loading that map may allow Google to set cookies or collect technical data under Google’s own policy. You can refuse non-essential cookies in your browser settings; essential cookies may be required for the site to function.

7. How long we keep it

Enquiry emails and WhatsApp threads are kept for as long as needed to quote, perform or follow up the work, and then for a reasonable period for accounts, tax and any claim that may arise. We then delete or archive them in line with our records practice. Website logs are kept only as long as the host retains them for security and operations.

8. Your rights

Subject to the Data Protection Act, 2019, you may ask us to:

• Access the personal data we hold about you
• Correct inaccurate data
• Delete data, where the Act allows
• Restrict or object to certain processing
• Receive data you provided, in a portable form, where that right applies

To exercise these rights, email Scalworks@gmail.com. You may also complain to the Office of the Data Protection Commissioner (ODPC) in Kenya if you believe your rights have not been respected.

9. Security

We use reasonable technical and organisational measures to protect personal data we hold. Email and WhatsApp travel over networks we do not control. Do not send passwords or payment card numbers through the website form.

10. Children

This website is intended for contractors, developers, facilities teams and other businesses. We do not knowingly collect personal data from children.

11. Changes

We may update this policy. The “last updated” date at the top will change. The current version is the one published on this page.
